Objectives of Programme's Learning Outcomes

  • Acquire the basic knowledge to understand the legal mechanisms in order to understand the concepts, techniques and terminology to express a rigorous legal thought
    • Have foundation of legal knowledge in order to work with more refined knowledge and legally consider increasingly complex situations

Learning Outcomes of UE

Understand the basics of criminal law, criminal offence, criminal liability and punishment, as well as the principles that govern criminal control. Demonstrate the place, essential mechanisms and aims of criminal law compared to other branches of law.

Content of UE

Study criminal law (general characteristics, autonomy, interpretation, referring to time, space and people), crimal liability (categories, moral elements and causes for justification, material elements, attempts), delinquancy (subject to criminal law, moral responsibility, punishable participation) and punishment (function, categories, punishments which limit freedom, work, rights and heritage, civil consequences, suspended sentences, reprieves, probation) illustrated by numerous examples of criminal acts.

Q1 UE Assessment Comments

1) The exam is a written one and consists of answering some open questions (one page is given to answer these questions) or ‘true or false' questions which require a few lines of explanation. Students must be able to STRUCTURE their thoughts, SELECT the essential information (main rules and exceptions, categories or comparisons with related or distinct concepts) and ORGANISE their answers. 2) The use of the Penal Code (non annotated, but underlining is authorised) is not compulsory, but is strongly advised as it can help students find the relevant articles. As such, students must be able to find a given legal disposition in their Penal Code. Penal Codes from any editing house are accepted. The most up to date Penal Code can be found on the Justice Ministry's website (www.just.fgov.be, choose the French tab for Belgian legislation, then choose ‘droit pénal' from the drop down menu " nature juridique ")and can be downloaded for free.
